FitSum Terms of Service

These terms govern your use of the FitSum mobile application and website, operated by Evovi Ltd (Company No. 16985656, registered in England & Wales). By creating an account or using FitSum you agree to these terms. If you do not agree, do not use the service.
1. Using FitSum
You must be at least 13 years old (or the minimum age required by law in your region) to create an account. You agree to use FitSum lawfully and only for its intended purpose.
2. Health & Fitness Disclaimer
FitSum is a fitness tracking and coaching tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The workout recommendations, coaching guidance, calorie estimates, and recovery/readiness indicators in FitSum are generated from general algorithms based on the data you provide, and are not a substitute for professional medical or fitness advice.
Exercise instructions and demonstration videos. FitSum's exercise library includes written instructions and short demonstration videos showing how an exercise may be performed. This content is general and educational: it is not personalised to your body, mobility, injury history, or experience level, and it does not replace in-person coaching or supervision by a qualified fitness professional. You are responsible for judging whether a given exercise, and the technique shown, is appropriate for you, for using equipment safely, and for stopping if something feels wrong. Evovi Ltd does not warrant that following the instructions or demonstrations shown will prevent injury.
Consult a qualified physician or healthcare professional before starting any new exercise programme, particularly if you are pregnant, have a pre-existing medical condition, are recovering from injury, or are otherwise uncertain about your fitness to exercise. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptom during a workout.
You use FitSum, and undertake any exercise it recommends or demonstrates, at your own risk. Evovi Ltd is not liable for any injury, health complication, or damage resulting from use of the app, its recommendations, or its exercise instructions or demonstration videos.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. Notify us immediately if you believe your account has been compromised.
You may delete your account at any time (see our Privacy Policy). Deleting your account does not automatically cancel an active subscription — cancel separately through the App Store or Google Play.
4. Subscription Terms
FitSum offers optional premium subscriptions with the following terms:
- Monthly: £7.99 / month.
- Annual: £49.99 / year.
- Lifetime: £149.99 one-time purchase, no recurring billing.
Prices are standard UK list prices; your local store listing is authoritative for applicable taxes and currency conversion.
- Free trial: the Monthly plan may include a 14-day free introductory period for eligible first-time subscribers. At the end of the trial, the subscription converts to a paid Monthly subscription unless cancelled at least 24 hours before the trial ends.
- Auto-renewal: monthly and annual subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
- Billing and management: all subscriptions are billed and managed through the Apple App Store or Google Play, depending on where you subscribed. We do not process payments directly and do not have access to your card details.
- Cancellation: you can cancel anytime via your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are given for unused time within a period, except where required by law or store policy.
- Free tier: FitSum's free tier has no time limit and does not require a trial or payment method to use.
- Price changes: if subscription pricing changes, we'll notify existing subscribers in advance in accordance with App Store / Google Play requirements before any new price applies to a renewal.
- Refunds: refund requests are handled by Apple or Google according to their respective refund policies, not by Evovi Ltd directly.
5. Acceptable use
You agree not to:
- Use FitSum for any unlawful purpose or in violation of these terms.
- Attempt to reverse engineer, decompile, or extract the source code of the app.
- Interfere with or disrupt the service, its servers, or its security.
- Access another user's account or data without authorisation.
- Upload or transmit malware, or use the service to send spam.
- Scrape, harvest, or bulk-collect data from the service.
- Misrepresent your identity or impersonate others.
We may suspend or terminate accounts that violate these terms.
6. Intellectual property
All content, software, design, and branding in FitSum (including the app, the FitSum name and logo, and the exercise/coaching content) is owned by Evovi Ltd or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable licence to use the app for your personal, non-commercial use.
You retain ownership of the data you enter into the app (workouts, measurements, photos, and other content you provide). By using FitSum you grant us a licence to use that data solely to provide and improve the service, as described in our Privacy Policy.
7. Termination
You may stop using FitSum at any time. We may suspend or terminate your access if you breach these terms, or if we discontinue the service (on reasonable notice where practicable). On termination, your rights to use the app end. Sections that by their nature should survive (including the disclaimers, limitation of liability, and governing law) will continue to apply.
8. Disclaimers and limitation of liability
To the extent permitted by law, FitSum is provided "as is" and "as available", without warranties of any kind (express or implied), including fitness for a particular purpose, and we do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Evovi Ltd will not be liable for any indirect, incidental, special, or consequential loss or damage, or any loss of profits, data, or goodwill, arising out of or in connection with your use of FitSum. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Evovi Ltd, its directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of: your breach of these terms; your misuse of the app; or your violation of any law or the rights of a third party. This does not apply to the extent a claim results from Evovi Ltd's own breach of these terms, negligence, or wilful misconduct.
10. Governing law and dispute resolution
These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer-protection laws in your country of residence provide otherwise.
11. General provisions
- Entire agreement: these terms, together with our Privacy Policy, constitute the entire agreement between you and Evovi Ltd regarding FitSum, and supersede any prior agreements on this subject.
- Severability: if any provision of these terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- No waiver: our failure to enforce any right or provision of these terms will not be considered a waiver of that right or provision.
- Assignment: you may not assign or transfer these terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these terms, without restriction, including in connection with a merger, acquisition, or sale of assets (see the Business Transfers section of our Privacy Policy).
12. Changes to these terms
We may update these terms from time to time. Material changes will be notified in-app or via email before they take effect. Your continued use of FitSum after changes take effect constitutes acceptance of the updated terms.
